*I understand that although every reasonable effort is made to use non-toxic, child-friendly materials, the Business cannot guarantee that any materials are free from allergens including but not limited to dairy, gluten, wheat, soy, nuts, fragrances, dyes, preservatives, or latex.

I understand that participation is voluntary and I assume all risks associated with allergies or sensitivities.

*DESCRIPTION OF ACTIVITIES

I understand this event may include, but is not limited to:

•Water

• Sand

• Mud

• Shaving cream

• Washable paint

• Finger painting

• Slime

• Play dough

• Kinetic sand

• Rice, beans, pasta, oats, and other sensory fillers

• Chalk

• Glue

• Foam and soap

• Bubble play

• Loose parts play

• Outdoor play

• Natural materials

• Shared toys and sensory equipment

I understand these activities are intentionally messy and may stain clothing, shoes, or personal belongings.

*ASSUMPTION OF RISK

I voluntarily choose to participate (or allow my child to participate) knowing that participation involves inherent risks including but not limited to:

• Slips, trips, and falls

• Cuts, scrapes, bruises

• Splinters

• Insect bites

• Heat exhaustion

• Sun exposure

• Wet surfaces

• Choking hazards if materials are misused

• Allergic reactions

• Contact with shared materials

• Injuries caused by another participant

• Damage to clothing or personal property

*I knowingly and voluntarily assume every risk associated with participation, whether known or unknown.

*PARENT/GUARDIAN SUPERVISION AGREEMENT

· I understand this is a caregiver-supervised event.

· The Business does not provide childcare.

· Parents and guardians remain solely responsible for supervising their children at all times.

· I understand staff members are event facilitators only and are not babysitters.

· If I leave my child unattended, I accept full responsibility for anything that may occur.

*PARTICIPANT RULES

To ensure everyone’s safety, I agree to:

• Treat others respectfully.

• Follow staff instructions.

• Keep sensory materials in designated areas.

• Use materials appropriately.

• Supervise my child at all times.

• Notify staff immediately if an injury occurs.

The Business reserves the right to remove any participant whose behavior creates an unsafe environment.

Removal due to unsafe behavior may occur without refund.

*RELEASE OF LIABILITY

To the fullest extent permitted by Texas law, I, on behalf of myself, my child, my heirs, executors, administrators, representatives, successors, and assigns, hereby release, waive, discharge, and covenant not to sue:

including its:

• Owner(s)

• Members

• Employees

• Volunteers

• Representatives

• Agents

• Event Hosts

• Venue Owners

• Property Owners

• Landlords

*from any and all claims, liabilities, lawsuits, demands, losses, damages, costs, attorney’s fees, expenses, or causes of action arising from participation in this event, including claims arising from ordinary negligence.

This waiver shall not apply to acts constituting gross negligence, reckless conduct, or intentional misconduct where such waivers are prohibited by law.

*INDEMNIFICATION AGREEMENT

I agree to defend, indemnify, and hold harmless the Released Parties against any claims, lawsuits, liabilities, damages, attorney’s fees, or expenses arising from:

• My actions

• My child’s actions

• My failure to supervise

• Damage caused by me or my child

except where prohibited by law.

*DAMAGE TO PROPERTY

I accept financial responsibility for intentional or negligent damage caused by myself or my child to:

• Venue property

• Equipment

• Toys

• Sensory bins

• Furniture

• Decorations

• Supplies

• Another participant’s property

*PERSONAL PROPERTY

The Business is not responsible for lost, stolen, damaged, or misplaced personal property including:

• Phone

• Jewelry

• Clothing

• Shoes

• Diaper bags

• Strollers

• Personal belongings

*EMERGENCY MEDICAL AUTHORIZATION

In the event of an emergency, I authorize the Business to contact emergency medical services.

I understand I am solely responsible for any resulting medical expenses.

*CANCELLATION & REFUND POLICY

I acknowledge and agree that:

• Registration reserves a limited event space.

• Refunds are not provided for no-shows.

• Refund requests made at least 72 hours before the event may receive a refund.

• Events may be canceled due to severe weather, unsafe conditions, emergencies, or insufficient enrollment.

• If the Business cancels an event, participants will receive a full refund.

*SEVERABILITY

If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Texas.

Any dispute arising under this Agreement shall be brought in a court of competent jurisdiction located within the State of Texas.

*ENTIRE AGREEMENT

This Agreement contains the entire understanding between the parties and supersedes all prior discussions, representations, or agreements.

*ACKNOWLEDGMENT

By signing below, I acknowledge that:

• I have carefully read this Agreement in its entirety.

• I understand its contents.

• I understand I am waiving certain legal rights.

• I have had the opportunity to ask questions.

• I voluntarily agree to all terms.

• I am at least 18 years old and am signing as the legal parent or guardian of the participant.
